Trump Officials Face Federal Contempt Inquiry Over Unauthorized Deportations… Binbin

WASHINGTON — A federal judge in Washington, D.C., has intensified scrutiny of former Trump administration officials for their role in allegedly violating court orders related to deportations to El Salvador. Judge James Booseberg has ordered key figures, including Christine Gnome and Emil Bove, to provide declarations detailing their actions, raising the prospect of a criminal contempt finding if they fail to comply.

The case centers on a court order prohibiting the removal of more than 100 individuals to high-security facilities in El Salvador, a directive that federal authorities allegedly ignored. According to court filings, approximately 137 men were removed without proper hearings, with reports indicating that many endured harsh treatment and possible abuse while in detention. The judge has emphasized that this proceeding is not a “mere academic exercise” but a critical inquiry into whether government officials willfully defied judicial authority.

Judge Booseberg’s order comes after officials attempted to invoke attorney-client privilege, executive privilege, and work-product protections to avoid submitting declarations. The judge, however, cited the crime-fraud exception, noting that claims of privilege do not shield individuals from investigation if their conduct potentially involved criminal activity. “The court will be mindful of attorney-client privilege, but also mindful of the crime-fraud exception,” the judge wrote in a December 8 order, effectively signaling that live testimony may be required.

The Department of Justice, under the direction of former Attorney General Pam Bondi, responded by filing a mandamus petition in the D.C. Circuit, arguing that the judge’s actions threatened both attorney-client privilege and the separation of powers. The DOJ also sought to prevent or limit live testimony, framing the proceedings as judicial overreach. “This radical, retaliatory campaign against the Trump administration will not stand,” the filing asserted, highlighting the administration’s position that the court’s inquiry exceeds its proper authority.

Legal analysts have described the case as a striking test of accountability for senior officials. Harry Litman, a former U.S. Attorney and legal commentator, noted that the Supreme Court has consistently affirmed the right to notice and a hearing before removal, and that broad claims of privilege will not automatically block judicial review. According to Litman, the court has spent months building a meticulous record to assess the administration’s actions, including prior attempts to offer declarations and witness testimony.

Observers also point to the significance of potential whistleblower testimony in the proceedings. Key individuals, such as attorneys involved in the deportation decisions, may provide evidence of internal discussions and decisions that contradicted court orders. Analysts suggest that refusal to participate could itself strengthen a contempt finding, with adverse inferences drawn against those who withhold testimony.
